At the end of January, both the Internal Revenue Service and the Department of Health and Human Services issued two sets of proposed regulations related to the individual mandate of the Patient Protection and Affordable Care Act.
And here is what jumps off the pages at me.
If two government bureaucracies have written regulations on the same material, who reviewed it to be sure that there are no conflicts?
If there are conflicts, whose version overrides the other?
Why do the penalties have a Cost of Living increase built in, when other parts of the tax law have had the same base for over 25 years?
What a nightmare this is going to be for small businesses (or any businesses for that matter) to administer. And these are only the regulations for one part of the law.
And then there are a list of those who would be exempt from paying the penalty. Thank goodness none of these people fall within my client profile. But it is interesting to note that illegal aliens are exempt from the penalties, while other parts of federal and state law mandate that medical facilities treat them. Why do they get a free ride when I hear our own military personnel are getting denied coverage?
